TERMS AND CONDITIONS FOR BOOKINGS AND USE OF THE SITE
The client accepts that dockspot acts only as an agent and facilitator of the transactions which the customer enters into with the service companies. dockspot is not, under any circumstances, responsible for the services which the customer has booked with one or more service companies. dockspot is not responsible in the event that the customer seeks compensation or makes a claim against insurance.
dockspot's services may only be used by customers who have read the terms and conditions in their entirety and who accept them unconditionally. It is not technically possible to proceed with the booking if the customer does not accept the terms and conditions. The terms and conditions became valid on 19 May 2009 and are valid until further notice.
The definitions given below have the same meaning, whether given in the singular or plural.
"Terms and conditions" means the terms and conditions for booking and use of the site.
"Booking fee" means an administrative charge for the administrative work, time spent, costs etc in connection with the maintenance and operation of the website.
"dockspot" means dockspot UK Ltd, 12 Montagu Mews West, W1H 2EE London, UK and its daughter company.
"Customer" means a customer who books, orders or buys one or more of the services which are available via the website.
"VAT" is value added or other tax on sales.
"Personal details" means all the information about an identified person or a person who can be identified from information saved in some form, including name, e-mail and postal address, telephone number, invoicing and account information and other information connected with the provision of dockspot's services.
"Special conditions for service companies" means the terms and conditions which are valid for the provision of the services in question and which shall be provided by each service company.
"Service" means a service which is sold via the website, e.g. a mooring at a marina or ancillary service such as electricity, breakfast, cleaning etc.
"Service company" means a company which provides services such as berths at a marina, restaurants etc.
"Website" means the website www.dockspot.com
dockspot provides an opportunity to book services on the website. dockspot acts as an agent for service companies and supplies their services to customers. These terms and conditions are valid only for this agency and not for the provision of the services themselves. The customer's contract is with the respective service companies and dockspot is not responsible for the quality or operation of the services. The terms and conditions for each service are those which attach to the respective terms and conditions of the service company in question, and the customer can see these during the booking process. Once a booking is made via the website, the customer accepts the particular conditions of the service company. No insurance is included in the prices given on the website. These terms and conditions can be changed at any point without prior notice. If they do change, they will become valid as soon as they are published on the website and are valid for all contracts entered into thereafter.
The website helps the customer to find marinas and makes necessary bookings for a variety of services and products. dockspot's role is that only of an intermediary in the transactions the customer enters into with the service company. dockpot is not responsible for the quality or delivery of the services. The customer guarantees that the customer is 18 or over, has the right to enter into the contract and will use the website in accordance with these terms and conditions. The customer is responsible financially for his or her activities on the website, including any changes of customer name and password. The customer guarantees that the details about the customers on the website are correct. If the customer uses the website in a fraudulent way or in a way which goes against the terms and conditions, this will constitute grounds for refusing to provide the customer with the services offered by dockspot or any other function of this website.
Cancellations or changes must be made in accordance with the conditions for the respective service company. A booking or order confirmation will be sent to the customer by e-mail. If the customer does not receive a confirmation by e-mail within 24 hours of when the booking was made, the customer must contact customer services by e-mail at: info@dockspot.se. Cancellation or a request for a change must be sent to info@dockspot.se marked cancellation/change. For every adjustment (for example, change of departure date, arrival date or itinerary) or cancellation which originates with the customer, a charge of SEK 150 will be made. Changes or cancellation must be made 7 days or more before arrival to be valid. Therefore no change or cancellation can be validated less than 7 days before arrival. If a repayment is made to a customer, the amounts previously paid, minus the booking fee, will be transferred to the account used for the payment via Payson.
dockspot acts as an intermediary on behalf of service companies when supplying their services.
Special terms and conditions are provided by the respective service companies.
Unless otherwise stated, prices on the website are given in Swedish Kronor, SEK.
The price for services ordered on the website must be paid direct to dockspot, who accepts such payments on behalf of the service companies via a secure payment system, provided by a third party. The booking is valid only after payment for the booked services has been made.
Claims and questions should be sent to dockspot by e-mail to: info@dockspot.se within 30 days of the end of the visit in question. dockspot accepts claims on behalf of the service company, but does not accept any responsibility for the services or their delivery.
Claims will not be considered after the above-mentioned 30 day period.
Swedish law is applicable to these terms and conditions. The Stockholm Court is authorize to judge any disputes arising from the contract or its interpretation.
Each case of force majeure, such as disruption of communication, bad weather or strike of service, etc., leads to the obligations in these Terms and Conditions that are affected by the events in question is repealed.
dockspot will not store personal data without the knowledge or permission of the customer. dockspot will not knowingly disclose personal data to third parties, except as is necessary to provide contracted services or for third parties to be able to provide contracted services. dockspot will allow the customer to review, correct and delete personal data, however, dockspot will take reasonable steps to protect the security of personal data we collect from the customer. By sending personal data to dockspot and / or using the Website, the customer agrees that dockspot may store, use and disclose such personal data in compliance with these Terms and Conditions and in accordance with what is permitted and required by law.
The information, programme software, productions and services provided on www.dockspot.com may contain factual or printing errors. dockspot can improve and/or correct information on www.dockspot.se/com at any time and does so regularly. dockspot and/or its partners who provide services will under no circumstances be responsible for any direct or indirect damage, delay or hindrance caused in connection with the use of the website.
